The New Castle News has announced in an article Monday it will challenge in court the police seizure of a newsroom computer that police say a reporter used to record a phone conversation with two public officials.
Northwest Lawrence Regional Police got a search warrant and took the computer July 25 when a reporter, who is married to the town's police chief, told the chief an interview he had given to another reporter was recorded without the chief's knowledge.
Pennsylvania law states that all parties must consent before a phone conversation can be recorded. The reporter who recorded the interviews has not been charged with a crime, but the district attorney said the investigation is ongoing, according to Editor and Publisher.
James Manolis, the newspaper's attorney, said in an Editor and Publisher article that the state's recording statue may not be legal and some past court cases have found the law doesn't always apply to journalists.
